The Procedural Roadmap
1. Opposition Proceedings (Section 18)
Any person may, within two months from the date of advertisement of an application in the Trademarks Journal, give notice in writing to the Registrar on Form TM-5. The grounds typically include lack of distinctiveness (Section 6) or similarity to an existing mark (Section 10).
2. Evidence and Hearing
Under Rules 46-50 of the Trademarks Rules 2015, parties must submit evidence by way of affidavits. The Registrar, after providing an opportunity for a hearing, shall decide whether registration is to be permitted.
3. Rectification of the Register (Section 51)
An 'aggrieved person' may apply for the cancellation or variation of a trademark registration on grounds of non-use (Section 42) or if the entry was made without sufficient cause. This application is filed via Form TM-26.
