Power of Attorney and Legal Documentation in Bangladesh
A Power of Attorney (PoA) is one of the most important legal documents for non-resident Bangladeshis and foreign investors, enabling a trusted person in Bangladesh to manage property, banking, legal proceedings, and other affairs on behalf of the principal.
Types of Power of Attorney
- General Power of Attorney — Broad authority to manage all legal and financial affairs in Bangladesh
- Special Power of Attorney — Limited authority for a specific transaction (e.g., sale of a specific property)
- Irrevocable Power of Attorney — Cannot be revoked by the principal — used in commercial transactions where the attorney's authority must be guaranteed
Execution Requirements
A PoA executed outside Bangladesh must be notarised by a Notary Public, and then either apostilled (if the country is a Hague Convention signatory) or legalised through the Bangladesh High Commission or Embassy. The PoA must then be registered at a Sub-Registrar's Office in Bangladesh before use in property or court matters.
