Eligibility for Patentability
Under Section 3 of the Patents Act 2022, an invention is patentable if it satisfies three cumulative criteria:
- Novelty: The invention must not have been disclosed to the public anywhere in the world before the filing date.
- Inventive Step: The invention must not be obvious to a person skilled in the art.
- Industrial Applicability: The invention must be capable of being made or used in any kind of industry.

The Registration Process Roadmap
International Filing via PCT
As a member of the WIPO-administered Patent Cooperation Treaty (PCT), applicants in Bangladesh can seek protection in up to 157 contracting states through a single 'international' patent application. Under Section 72 of the Patents Act 2022, the DPDT acts as a receiving office for international applications filed by Bangladeshi residents or nationals.
- International Phase: Filing the PCT application, followed by an International Search Report (ISR) and Written Opinion.
- National Phase: Entering the Bangladesh jurisdiction within 30 or 31 months from the priority date to seek local enforcement.

What is the duration of patent protection in Bangladesh?
Pursuant to Section 31 of the Patents Act 2022, the term of every patent granted shall be 20 years from the date of filing of the application, subject to the payment of prescribed renewal fees.
Are pharmaceutical products eligible for patent protection?
Under the current TRIPS transition period for LDCs, Bangladesh provides a 'mailbox' system. However, Section 5 of the Patents Act 2022 outlines specific exclusions, and pharmaceutical patents are subject to the waivers granted by the WTO TRIPS Council.
Can a patent be revoked for non-working?
Yes, under Section 56 of the Patents Act 2022, any interested person or the Government may apply for the revocation of a patent if the invention is not being worked in Bangladesh on a commercial scale without valid reason.
