Mitigation Strategies for Importers and Exporters

  1. Strict Compliance (Article 14, UCP 600): Banks must examine a presentation to determine, on the basis of the documents alone, whether or not the documents appear on their face to constitute a complying presentation.
  2. Notice of Refusal (Article 16, UCP 600): If a bank decides to refuse to honor or negotiate, it must give a single notice to that effect to the presenter. This notice must state each discrepancy and must be provided no later than the close of the fifth banking day following the day of presentation.
  3. Fraud Exception: Under Bangladesh law, the 'Autonomy Principle' of an LC can only be pierced in cases of established fraud. The Code of Civil Procedure 1908 allows for temporary injunctions (Order 39) only in extreme cases where the fraud is egregious and known to the bank.
  4. Regulatory Reporting: Any dispute involving non-repatriation of export proceeds must be reported to the Foreign Exchange Policy Department of Bangladesh Bank as per Section 12 of the Foreign Exchange Regulation Act 1947.

Frequently Asked Questions

What is the time limit for a bank to notify discrepancies under UCP 600?

Pursuant to Article 16(d) of UCP 600, the issuing or nominating bank has a maximum of five banking days following the day of presentation to provide a notice of refusal stating all discrepancies.

Can an importer stop LC payment through a court injunction in Bangladesh?

Under Order 39, Rules 1 and 2 of the Code of Civil Procedure 1908, a court may grant an injunction, but the threshold is exceptionally high. The applicant must prove 'established fraud' or 'irretrievable injustice' to override the bank's independent obligation under the LC.

Which law governs the repatriation of export proceeds in LC disputes?

Section 12 of the Foreign Exchange Regulation Act 1947 mandates that all export proceeds must be repatriated within the timeframe prescribed by Bangladesh Bank (typically 4 months), regardless of pending commercial disputes.
