Arbitration and Mediation in Bangladesh
Arbitration in Bangladesh is governed by the Arbitration Act, 2001, which is based on the UNCITRAL Model Law. Bangladesh is a signatory to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, making foreign arbitral awards (from New York Convention countries) enforceable through the Bangladesh courts.
Domestic Arbitration
Parties to a contract governed by Bangladesh law may include an arbitration clause directing disputes to ad hoc arbitration under the Arbitration Act, 2001 or to institutional arbitration through the Bangladesh International Arbitration Centre (BIAC). The arbitral tribunal's award is final and binding and may be enforced as a court decree.
International Arbitration and Bangladesh Parties
International contracts involving Bangladesh parties frequently provide for arbitration in Singapore (SIAC), London (LCIA), or Hong Kong (HKIAC). LegalBD advises Bangladesh parties in international arbitration proceedings, including preliminary jurisdictional challenges, enforcement proceedings in Bangladesh, and anti-suit injunctions.
Mediation
Bangladesh courts are required to attempt mediation before proceeding to trial in civil matters. Private mediation — increasingly common in commercial disputes — offers faster and more confidential resolution. Contact us about arbitration or mediation.
